In view of the foregoing, counsel appearing on behalf of the petitioner seeks leave to withdraw this petition with liberty to approach the concerned magistrate in an appropriate proceeding in accordance with law along with liberty to institute appropriate proceedings in accordance with law seeking damages against the respondent no. 3.
