The appellant assail an order dated 7th February, 2018 passed by the learned Single Judge in CS(OS) 185/2010. We find that a detailed extraction of the manner in which the plaintiff has conducted itself in prosecuting the CS(OS) No. 185/2010 for over eight years, has been noted.

As a result, the court has merely proceeded to frame issues in the suit. It appears that 53 issues have been necessitated in view of the plaintiff's stand that the properties which are the subject matter of the issues were HUF properties. 2.

In our view, such an order is not appealable. pg. 1 of 2

In view of the above, the appeal and the applications are dismissed.
