Petition under Section 528 B.N.S.S. has been filed on behalf of the Petitioner for quashing of FIR No.0303/2024 under Sections 279/338 IPC, registered at PS: Shalimar Bagh, Delhi and all proceedings emanating therefrom.

Learned APP for the State appears on advance Notice. 5.
It is submitted that draft Closure Report had been prepared by the Investigating Agency on 29.10.2024 by observing that as per CCTV footage, no prima facie negligence of the driver (Petitioner Pankaj Garg) of the offending vehicle can be made out. However, I.O. submits that pendrive of the CCTV footage needs to be supported with a 65B Certificate of landlady, who is not available and therefore, Closure Report has not been filed before The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Considering the fact that Closure Report has already been made and is only to be placed before the learned Trial Court, there is no ground for quashing of the FIR on merits.

In view of aforesaid, Petition along with pending Applications is disposed of, with liberty to the Petitioner to pursue the matter, in accordance with law.
