% 26.05.2026 CRL.M.A. 16892/2026 (for early hearing) This is an application seeking early hearing of the CRL.M.C. 8460/2025.
For the reasons stated therein and with the consent of Mr. Hitesh Vali, learned Additional Public Prosecutor, the application is allowed, and CRL.M.C. 8460/2025 is taken up for hearing. The application is accordingly disposed of.
CRL.M.C. 8460/2025 & CRL.M.A. 16905/2026 (to allow the petitioner to join the investigation) 1.
Petitioner No.1 is the sister-in-law of the respondent No. 2 (complainant in FIR No. 76/2023 dated 05.10.2023, registered at P.S. Women and Children, Delhi, under Sections 498A/406/34 IPC). Petitioner No. 2 is the husband of petitioner No. 1. 2.
By way of the present petition, the petitioners have challenged notice dated 06.11.2025 issued by the Investigating Officer directing them to join investigation on 28.11.2025 in connection with the aforesaid FIR.

On 27.11.2025, this Court passed the following order: "1. Counsel for the Petitioners seeks one week's accommodation to take instructions and confirm whether the Petitioners will come to India to have their statements recorded.
2. Mr. Satinder Singh Bawa, APP for the State, assures that in case the Petitioners come down in person, their statements will be recorded on the same date.
3. Re-notify on 17th December, 2025.
4. Till the next date of hearing, notices issued by the Investigating Officer are kept in abeyance."

CRL.M.A. 16905/2026 has now been filed, in which the petitioners have stated as follows:
"6.
That in compliance with the aforesaid order and in furtherance of her bona fide intention to cooperate with the investigation, the Petitioner is now in a position to visit India during the period from 09.06.2026 to 15.06.2026 and is willing to join the investigation within the said timeframe.

That it is, therefore, just, expedient, and in the interest of justice that this Hon'ble Court may be pleased to permit the Petitioner to join the investigation in a time-bound manner and direct, the Investigating Agency to complete the necessary proceedings, including recording of statements and any other required formalities, within the said period."

Having regard to the aforesaid averments, Mr. Hitesh Vali, upon instructions, submits that the petitioners may be directed to appear before the Investigating Officer on 10.06.2026 at 11:00 A.M. 6.

10.06.2026 at 11:00 A.M. and cooperate with the investigation. 7.
In view of this position, no further orders are sought in CRL.M.C. 8460/2025, and the petition is disposed of, alongwith all pending applications.

The next date of hearing fixed before this Court, i.e., 09.07.2026, stands cancelled.
