% 10.05.2016 Vide this petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C, the petitioner seeks parole as his mother expired on 26.11.2015 and he wants to keep himself in social relationship.
Status report has been filed by the State. The address of the petitioner has been verified. It is further reported that the petitioner was earlier granted four weeks parole from 29.09.2015 to 27.10.2015. However, learned ASC for State submits that so far one year has not elapsed from his last release on parole.
As per parole guidelines, there should be a gap of at least six months when last parole is granted. The nominal roll of the petitioner reflects that he was granted parole 29.09.2015 to 27.10.2015 as such period of six months has expire. As per report, he has surrendered in time. His overall conduct is also reported to be satisfactory. As such, in view of the parole guidelines 9.6 "to maintain family and social ties", the petitioner is ordered to be released on parole for a period of two weeks effective from the date of his release (i) On furnishing personal bond in the sum of Rs.20,000/- with one surety in the like amount to the satisfaction of the learned Trial Court concerned. (ii) He is also directed not to contact the prosecutrix or any of her family members during this period or to indulge in any illegal activities. (iii) He is further directed to furnish his address as well as contract number to Suptd. Jail as well as concerned SHO.
A copy of this order be sent to Superintendent Jail for information. Petition stands disposed of accordingly.
