O R D E R

% 20.05.2026 I.A. 14143/2026 (u/O XXIII Rule 3 of CPC) 1.

This is an application filed jointly on behalf of the plaintiff and defendant under Order XXIII Rule 3 of the Code of Civil Procedure, 1908. 2.

Learned counsel for the parties state that under the aegis of the Delhi High Court Mediation & Conciliation Centre, the inter-se disputes have been resolved. They state that the terms of the settlement have been reduced into writing vide Settlement Agreement dated 08.04.2006. The said Settlement Agreement alongwith all its annexures is taken on record. 3.

The terms of the settlement have been recorded in para 1 to para 9 of the Settlement Agreement.

The parties shall remain bound by the terms of the settlement. The compliances are stated to be complete.

Let a decree sheet be drawn up in terms of the Settlement Agreement from para 1 to para 9 as also the prayer clause of the plaint in para 46(iv) of the suit.

The plaintiff shall be refunded the Court Fees under Section 16 of the Court Fees (Amendment) Act, 2006 upon completion of all the formalities, as per rules.
