Ms. Mital, learned counsel for the petitioner, states that in the present case, it is the respondent who is the claimant before the Arbitrator and has sent an email stating that the respondent is opposing the present petition.

She further states that in the arbitration proceedings, it is only the claim of the respondent and there is no counter claim preferred by the petitioner. She also states that the respondent has also not paid the fee of the Arbitrator.

For the said reasons, she does not press the present petition with liberty to revive the same if and when the situation so arises. 4.

In view of her statement, the present petition is dismissed as withdrawn.
