This hearing has been done through hybrid mode. 2.
The present petition under Section 25B(8) of the Delhi Rent Control Act, 1958, seeks the following prayers:
"i) set-aside the impugned eviction order/judgment dated 21.08.2025 passed by Ms. Alka Singh, Ld. Additional Rent Controller, (District West) Tis Hazari Courts, Delhi in Petition No.ARC 84/2024 in case titled as "Smt. Sumitra Kaur Vs. Smt. Rajni Devi" whereby the leave to defend application of the petitioner herein has been dismissed and an eviction order has been passed against the petitioner in respect of the property bearing No.RGA-200, First Floor, DDA Flats, Raghubir Nagar, New Delhi-110027;
ii) remand the case back to the Ld. Trial Court for trial after granting leave to defend to the petitioner herein to contest and defend the eviction petition No. ARC 84/2024; iii) Pass any other/further order(s) instruction(s) and direction(s) as this Hon'ble Court may deem fit and proper in the facts and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Vide order dated 29.01.2026, it was recorded that the petitioner would vacate the subject premises within a period of 2 months, i.e., on or before 27.03.2026, and accordingly, an affidavit of undertaking with respect to the same was to be filed.

Learned counsel for the petitioner submits that an affidavit dated 30.01.2026 to the said effect was filed; however, the same is lying under objection. A copy of the same has been handed up in Court today, wherein, it has been stated as under: - "3. That the tenanted premise is situated at: RGA - 200, First Floor, DDA Flats, Raghubir Nagar, New Delhi - 110027. 4.
That in compliance of the aforesaid order passed by this Hon'ble Court, I hereby state and undertake that I shall vacate and hand over peaceful and vacant possession of the said premises on or before 28/03/2026, strictly in accordance with the said order. 5.
That I further state that I shall remove all my personal belongings from the premises and hand over the keys at the time of vacating the premises.

That no third-party interest has been created by me in respect of the said premises and the possession shall be handed over free from any encumbrance."

Let the affidavit of undertaking be placed on record. 6.
In view of the above, the learned counsel for the petitioner seeks leave to withdraw the present petition.
