Pursuant to the directions issued by this Court on the last date of hearing, the Rent Agreement has been placed on record by the petitioner, to submit that the petitioner is the owner of House No. 645, Pocket 6-II, Sector-2, Rohini, District-North West, Delhi-110085, wherein, his tenant resides.

This Court notes that the present writ petition pertains to unauthorized construction in Flat No. 45, Keshav Apartment, Pocket No. F 23, Sector-3, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Learned counsel appearing for the respondent-Municipal Corporation of Delhi ("MCD"), on instructions, submits that there are certain deviations from the Sanctioned Building Plan in the property in question, which already stand booked and Demolition Order already stands passed. 4.

This Court takes note of the fact that the owner/occupier of the property in question has not been made a party, however, since a Demolition Order is stated to have been passed much earlier, the MCD is enjoined upon to take action, in accordance with law.

This Court also takes note of the submission made by learned counsel appearing for the MCD that the petitioner is also guilty of unauthorized construction.

Accordingly, the MCD is granted liberty to inspect the premises of the petitioner, i.e., House No. 645, Pocket 6-II, Sector-2, Rohini, North West District, Delhi-110085. In case, any unauthorized construction is found, the MCD is at liberty to take action, after following the due procedure and in accordance with law.

Rights and contentions of the parties are left open. 8.

In case, any party is aggrieved by any action or non-action on the part of the MCD, their right to seek remedies in accordance with law, is kept open.

With the aforesaid directions, the present writ petition is accordingly disposed of.
