O R D E R
% 20.03.2019 This is an application under Section 438 of Code of Criminal Procedure seeking anticipatory bail in case FIR No. 111/2018 under Sections 420/406/498/471 of the Indian Penal Code registered at Police Station - Keshav Puram.
Mediation talks have been failed.
In compliance of order dated 24.03.2018, the petitioner deposited Rs.10,00,000/- (Rupees Ten Lacs Only) with the Registrar General of this Court and interim protection was granted to him. Vide order dated 30.07.2018, Rs.5,00,000/- (Rupees Five Lacs Only) out of said Rs.10,00,000/- were directed to be released to the respondent No. 2/complainant. Learned counsel for the complainant submits that the complainant has been taking care of the infant independently and she may be allowed to withdraw the balance amount of Rs.5,00,000/- deposited with the Registrar General to which
learned counsel for the petitioner has no objection. Accordingly, it is directed that balance amount of Rs.5,00,000/- deposited with the Registrar General of this Court be released to the complainant/Mrs. Shilpi Mittal. However, the amount of Rs.10,00,000/- so released to the complainant shall be without prejudice and subject to future adjustments (if any).
Investigating Officer is present in Court today and submits that the investigation has been carried out and the petitioner is no more required for investigation.
Keeping in view the facts and circumstances of the case, interim order dated 24.03.2018 is confirmed and it is directed that in the event of arrest till filing of the chargesheet, the petitioner, Piyush Mittal be released on bail on the following terms and conditions:- (i) That the petitioner shall furnish a personal bond in the sum of Rs.25,000/- with one surety of the like amount subject to the satisfaction of Arresting Officer/SHO concerned; (ii) That the petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required;
In case of default of aforementioned condition, the State is at liberty to take appropriate recourse in accordance with law.
Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case.
Application stands disposed of.
