The present application has been has been filed under Section 439(2) Cr.P.C. for cancellation of bail granted to the respondent no.2. Perusal of file shows the present petition came up for hearing on 29.05.2014 and notice was issued to the respondent no.2 for 28.11.2014.
On 28.11.2014, the service report was awaited and notice was again issued to respondent no.2 for 18.02.2015. On 18.02.2015, the matter was adjourned to 13.07.2015. On 13.07.2015, fresh process was issued for 24.11.2015 but no step for service was taken by the petitioner. On 24.11.2015, fresh notice was issued for 09.03.2016 but again steps were not taken for service. On 09.03.2016, again notice was issued to the respondent no.2 for today on taking fresh steps by the petitioner, but again steps were not taken by the petitioner.
Today neither the petitioner appeared nor his counsel. Learned APP for the State has submitted that in the present matter the charge sheet has already been filed in the Court. It is apparent that the petitioner is no more interested in the prosecution of the present matter.
