The petitioner seeks mandamus for registration of FIR. It is submitted by learned counsel that earlier, the petitioner filed a criminal complaint case with an application under Section 156(3) Cr. P.C. but the application was dismissed, so pre-summoning evidence is being recorded. In this backdrop, after addressing partly, learned counsel for petitioner seeks permission to withdraw this petition without prejudice to his stand before the Magisterial Court.
