% 14.09.2018 C.M. 37805/2018 By way of this application, petitioner seeks to place on record Certificate from the local MLA.

Learned counsel for respondent-Insurer submits that there is no objection to this application.

The application is accordingly allowed and the Certificate of 25th August, 2018 of concerned MLA is taken on record. The application stands disposed of.

CM(M) 418/2018 With the consent of counsel for the parties, this petition is heard today itself and the date of 15th October, 2018 already fixed in the petition is cancelled.

In this petition, release of ₹7,00,000/-, out of the awarded amount of ₹11,25,000/- is sought by petitioner while relying upon estimate of 14th April, 2017 obtained from the concerned Contractor. Upon hearing, impugned order of 20th September, 2017 is set aside with direction to the Branch Manager of State Bank of India, Saket Court Complex Branch, New Delhi, to release sum of ₹7,00,000/- out of the remaining deposited amount of ₹10,25,000/- to the concerned Contractor after taking an affidavit from him that the amount so released to him would be spent only in reconstructing petitioner's house. With aforesaid directions, this petition is disposed of. Dasti.
