Writ Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of FIR No.0280/2016 under Sections 279/304-A IPC, registered at P.S.: Civil Lines, Delhi, in terms of Settlement Deed dated 29.10.2024.

As per the case of the prosecution, Chander Bhan, aged about 63 years, died in a Car accident on 26.10.2016 and present FIR got registered. He was survived by his wife, two sons and one daughter. Family of Deceased has already received Rs.12,92,600/- in MACT. In addition, parties have amicably settled the dispute and Rs.50,000/- to each of the Legal Representatives of the deceased have already been given. Petitioner and Respondent No.2 are present through VC and other are in person and have been identified by the IO. It is submitted that Petitioner is suffering from Prostate Cancer and is completely bed-ridden. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Settlement dated 29.10.2024 with their wish and will.

Learned Counsel for Petitioner submits that the parties have no grievance against each other. Since Respondents have already made a statement before the Court that they do not want to pursue the proceedings in FIR, the present Petition be allowed and FIR No.0280/2016 be quashed. 5.

In view of Settlement Deed dated 29.10.2024, present Writ Petition has been filed.

Respondents are present and submit that they have no grievance against the Petitioner and also no objection to the quashing of FIR. 7.

In view of the fact that the dispute between the Petitioner and Respondents has been amicably resolved in terms of Settlement dated 29.10.2024 and Respondents have also given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR.

Consequently, FIR No.0280/2016 under Sections 279/304-A IPC, registered at P.S.: Civil Lines, Delhi and all consequential proceedings emanating therefrom are quashed.
