CM APPL. 56133/2025 (on behalf of the respondent No.1 for condonation of delay in filing affidavit) 1.

This is an application seeking condonation of delay of 226 days in filing the counter-affidavit.

Considering the averments made in the application, the same is allowed. The present petition has been filed by the petitioner seeking that the Airports Authority of India (AAI) be directed to issue a 'No Objection Certificate' to the petitioner society, to unblock the lien created in favour of the AAI in respect of FDR No.0346401000745 issued by respondent no.2 amounting to Rs.80,000/-.

In the counter-affidavit filed on behalf of the respondent no.1, it has been stated as under:

"5. I state that since after conducting the due diligence by Respondent No. 1, as on date no claim is pending from AAI on Naya Savera, therefore, subject to deposit / filing of the Indemnity Bond by M/s. Naya Savera stating that in case any claim which comes to the knowledge of AAI regarding any liability of M/s. Naya Savera towards AAI, the same shall be settled by it forthwith, NOC as sought by the petitioner can be issued by AAI in favour of the Petitioner."

Learned counsel for the petitioner is agreeable to submit an indemnity bond as sought by the Airports Authority of India. Let the same be done expeditiously, whereupon the requisite NOC shall be issued by AAI. Let the same be done within a period of one week from the date of receipt of the indemnity bond.

The petition is disposed of in the above terms. 8.
