The matter is listed in this Court pursuant to the order of the Joint Registrar dated 6.1.2016 closing the right of the defendant to lead evidence.

This is a suit filed by the plaintiff alleging infringement of its patent.

Issues in the suit were framed way back on 22.11.2013 and thereafter the record shows that plaintiff has failed to lead any evidence on 4.3.2014, 16.4.2014, 17.11.2014 and 6.1.2016. In fact, no one appeared for the plaintiff even on the last two dates of hearing i.e 1.12.2015 and 6.1.2016. 3.

In view of the above, the suit is dismissed in default and for non-prosecution.
