% 07.03.2018 Present petition under Section 482 Cr.P.C. is abuse of process of law. Petitioner has prayed for his release on the sentence already undergone by him.
Petitioner was convicted under Sections 279/304A IPC by the trial court vide judgment dated 25th April, 2015.
He was sentenced to simple imprisonment for 6 months under Section 279 IPC and 1 year simple imprisonment under Section 304A IPC.
Sentences were directed to run concurrently. Petitioner preferred Cr.A.55/2015 before the Additional Sessions Judge, which has been dismissed vide judgment dated 3rd September, 2015. Crl. Rev. P. 616/2016 filed by the petitioner in this Court has been dismissed vide order dated 15th September, 2016. Petitioner preferred SLP 95/2017. During the course of hearing, learned counsel for
the petitioner admits that SLP has also been dismissed in default. Sentence of the petitioner cannot be altered with by this Court in an independent petition under Section 482 Cr.P.C.
For the foregoing reasons, petition is dismissed. Miscellaneous application is disposed of as infructuous.
