% 25.05.2016 Present writ petition has been filed seeking a direction to respondents to cancel their de-sponsorship from CNG operatorship/management of CNG Pump, Sector-29 and Sector-3 (D.T.C.), Rohini, Delhi. While it is the case of the petitioner that he never applied for empanelment under the Security Agency Scheme in 28th July, 2010, the respondents have produced the alleged application form being Annexure R6. Learned counsel for petitioner emphatically contends that the said document is forged and fabricated and was never executed by the petitioner.

Since this case involves serious disputed questions of fact, the same cannot be adjudicated upon in writ proceedings. Accordingly, present writ petition is dismissed with liberty to the petitioner to file appropriate legal proceedings in accordance with law. To facilitate filing of such alternate proceedings, it is directed that the time spent in prosecuting the present writ petition shall be excluded while determining the period of limitation for filing of said proceedings.
