O R D E R

% 18.07.2018 There is a dispute between the parties in relation to the Agreement to sell dated 12.12.2017.

It is noted that Capital First Ltd. is claiming that the property was mortgaged in its favour by Smt. Krishna Gupta and Capital First Ltd. is already seeking to enforce its rights against the said property. Certain interim orders have also been passed on the petitions filed by it, being OMP (I) (Comm.) 151/2018 and 206/2018.

In view of the above, no further interim order is required in these petitions.

Learned counsels for the parties request that an Arbitrator be appointed for adjudicating the disputes that have arisen between the parties in relation to the above mentioned Agreement to sell. I accordingly appoint Justice V.S. Aggarwal, a retired Judge of this Court as an Arbitrator (C-52, Swami Nagar (North), New Delhi-110016, 9891175550) The Arbitrator shall give his disclosure statement under Section 12 of the Arbitration and Conciliation Act, 1996 before proceeding with the reference.

The petitions are disposed of in the above terms and with no order as to cost.
