At the outset, learned counsel for the respondents raises a preliminary objection with regard to the maintainability of the present petition in this Court on the ground that no part of the actionable cause of action has arisen within the territorial jurisdiction of Delhi. He points out that the petitioner is presently posted at Anantnag, Jammu & Kashmir and the order dated 16.09.2015 that he has impugned in the petition, has been passed by the Deputy Inspector General of Police, Group Centre - First, CRPF. 2.

It is pertinent to note that a preliminary objection with regard to territorial jurisdiction has also been raised by the Registry. W.P.(C) 2659/2016

Counsel for the petitioner seeks leave to withdraw the present petition while reserving the right of the petitioner to assail the impugned order dated 16.09.2015, before the competent court vested with territorial jurisdiction in that regard.

Leave, as prayed for, is granted. The petition is dismissed as withdrawn alongwith the pending application.
