Learned counsel for the respondent-New Delhi Municipal Council ("NDMC") submits that the present petition has become infructuous, as the present petition was filed on the basis of the order dated 15th March, 2024 passed by the Estate Officer, by way of which, the Eviction Petition filed by the NDMC had been dismissed.

Learned counsel for the NDMC submits that thereafter an appeal being PPA No. 06/2025, titled as "New Delhi Municipal Council Versus Channi & Anr.", was filed before the Principal District and Sessions Judge. He submits that vide judgment dated 01th July, 2025, passed by the Principal District and Sessions Judge, Patiala House Courts, New Delhi, the appeal of the respondent-NDMC has been allowed.

He submits that the matter has now been remanded back to the Estate Officer to decide the Eviction Petition, afresh. The judgment dated 15th July, 2025 passed by the learned Principal District and Sessions Judge, Patiala House Court, New Delhi in PPA No. 06/2025, is taken on record.

At this stage, learned counsel for the petitioner submits that he may be granted liberty to withdraw the present writ petition. 6.

Accordingly, noting the aforesaid, the present writ petition is dismissed as withdrawn.
