Petitioner is facing trial for commission under Sections 132, 221, 351(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 353,186, 506, 34 IPC) and Section 27 of Arms Act, 1959 arising out of FIR No.148/2025 dated 04.02.2025, registered at P.S. Kotwali.

The incident in question is of February, 2025, when the petitioner was apprehended with a pistol and 5 cartages. He was accompanied by co-accused-Farman who, allegedly, fled from the spot. Such co-accused is still, reportedly, at large and coercive process has been issued against him. 3.

The Charge-sheet has already been filed and charges have also been framed.

previous involvements as at that time, it was apprised that there are 25 cases in which he is involved.

Learned counsel for petitioner submits that there are only three cases pending against him. It is further submitted that there are nine cases wherein the petitioner has been acquitted and there is only one case wherein he was convicted and even such conviction was based on 'plea of guilt' and he was sentenced to the period already undergone.

Learned counsel for petitioner also submits that in the rest of the matters, the petitioner had been discharged and there is no other case pending against him, except for the case in hand.

The case is already at the stage of recording of prosecution evidence. 8.

Keeping in mind overall facts of the case and the fact that he is on bail in all the other pending matters, the applicant is directed to be released on bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class.
