Applicant seeks anticipatory bail in a case arising out of FIR No. 534/2025 dated 10.11.2025, registered at Police Station New Ashok Nagar, for offences under Section 318(2)/337/3(5) of BNS (corresponding Sections 417/466/34 of IPC).

When the present anticipatory bail application was taken up by learned predecessor Bench on 05.12.2025, while taking note of certain relevant aspects, it directed that no coercive action be taken against the applicant, subject to his joining investigation.

The Investigating Officer is present in Court, and learned Addl. P.P. for the State, on instructions from the Investigating Officer, submits that though the applicant has joined the investigation, however, it seems that he has BAIL APPLN. 4596/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. damaged his mobile device with some ulterior motive. She submits that since the device was in damaged condition, it was not taken into possession. 4.
Learned counsel for the applicant submits that there is no deliberate angle involved, and the police can always seize the device and can even send it to forensic laboratory, if it so desires. She further submits that the main culprit happens to be son-in-law of the applicant, who is already in custody, and his daughter i.e. Aarti, who is also a co-accused in the present matter, has also been granted anticipatory bail by this Court on 28.01.2026. 5.
The applicant has no previous involvement of any nature whatsoever. 6.
Keeping in mind the overall facts and circumstances of the case, the abovesaid interim order dated 05.12.2025 is hereby made absolute. 7.
The applicant would join investigation as and when so further directed and, in the event of his arrest, he be released on bail by the Arresting Officer on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each. 8.
The police would be at liberty to seize the mobile device in question, if the same is found required for any investigational purpose. 9.
The applications stand disposed of in aforesaid terms.
