Petitioner/plaintiff has assailed order dated 25.09.2025 of the learned Commercial Court, whereby his application for filing additional documents at the stage of recording evidence was dismissed, observing that the petitioner/plaintiff was trying to fill in the lacunae. Paragraph 9 of the impugned order bears crux of the issue.

However, after addressing partly, learned counsel for petitioner/plaintiff seeks permission to withdraw this petition and requests that at least cost imposed by the trial court in the impugned order may be recalled. In view of circumstances explained by learned counsel, the cost imposed in the impugned order is recalled and the petition as well as the accompanying applications are dismissed as withdrawn.
