The Petitioner lodged a complaint on 1st January, 2022 before the SHO, P.S. Mukherjee Nagar seeking registration of an FIR against Respondents No. 2 and 3. Since no action was taken, an application under Section 156(3) of the Code of Criminal Procedure, 19731 was filed before the Court of ACJM, North, Rohini Courts, Delhi. 2.

The said application was dismissed by order dated 8th August, 2024. The Petitioner assailed the said order in Criminal Revision Petition [CR No. 1735/2024], wherein the Sessions Court set aside the order dated 8th August, 2024 and remanded the matter to the Trial Court with a direction to decide the application under Section 156(3) Cr.P.C. afresh. 1 "Cr.P.C."

The Petitioner thereafter moved an application for early hearing before the Court of ACJM, which was declined by order dated 21st August, 2025.

The present petition seeks a limited direction to the Trial Court to decide the application under Section 156(3) Cr.P.C. in compliance with the directions of the Sessions Court dated 16th July, 2025. 5.

In the opinion of the Court, the jurisdiction of this Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ought not to be invoked for deciding the cause list of the Trial Court. The Trial Court has its own docket constraints and has to prioritise older matters over newly instituted proceedings. Accordingly, no directions are warranted at this stage. Nonetheless, the Trial Court shall consider the Petitioner's application, and if any urgency is made out, suitable directions may be issued.
