The present petition has been filed seeking the following reliefs:- "a. Set aside / quash the Impugned Order dated 15.11.2025 passed by the Learned Judge, Family Court, South District, Saket, New Delhi in I.A. 3/35 in M.T. Case No. 499/2024 titled Megha Shingla & Ors. vs. Kunal Shingla, whereby the Petitioner's Early Hearing Application has been dismissed without consideration on merits;
b. Direct the Ld. Principal Judge, Family Court,South District, Saket Courts, New Delhi to expeditiously adjudicate the matter in M.T. Case No. 499/2024 titled Megha Shingla & Ors. vs. Kunal Shingla c. Pending disposal of the M.T. Case No. 499/2024 titled Megha Shingla & Ors. vs. Kunal Shingla, grant ad-interim financial support to the Petitioner and the two minor children, towards their daily living The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
expenses, routine needs, medical requirements and extracurricular activities, in a reasonable sum as this Hon'ble Court may consider just and proper in the interest of welfare of the minor children."

Mr. Anubhav Lamba, the learned counsel appearing for the Petitioner submits that the only concern of the Petitioner is that her application filed under Section 125 Cr. PC praying for interim maintenance should be disposed of expeditiously. Mr. Lamba refers to the third proviso to Section 144 (1) of BNSS, 2023 to contend that such an application, as far as possible is to be disposed of within a period of 60 days.

He submits that the application seeking interim maintenance was filed by the Petitioner alongwith the main Petition on 19th December 2024, but till date, the said application has not been disposed of in terms of the third Proviso to subsection (1) of Section 144 of BNSS,2023.

In view of the above, issue notice.

Mr. Adab Singh Kapoor, the learned counsel appearing on behalf of the Respondent accepts notice.

In view of the limited relief sought by the Petitioners and regard being had to the third Proviso of sub-section (1) of Section 144 of BNSS, 2023, the learned Trial Court is requested to expedite the disposal of the application of the Petitioners seeking interim maintenance, preferably on the next date or within a period of one month thereafter.

learned Trial Court i.e. 08th January, 2026, so as to enable the learned Trial Court to expeditiously dispose of the said application. The parties may also file their respective affidavit of disclosure of assets and liabilities in terms of the decision of the Hon'ble Supreme Court in Rajnesh vs. Neha & Ors., (2021) 2 SCC 324, on or before the next date.
