O R D E R

The learned counsels appearing on behalf of the parties inform the Court that the mediation has been partly successful inasmuch as alternative site has been allotted by the L&DO to the plaintiff for shifting its facility viz. PNG Field Regulator Station (FRS), situated on Ring Road, Sarojini Nagar, New Delhi.

The only matter of concern for the NBCC seems to be the time which is likely to be taken by the plaintiff for shifting its said facility. 3.

Mr. Prashant Mehta, learned counsel appearing on behalf of plaintiff submits that out of the total area of the plot which is about 1650 Sq. Meters, the facility is confined to only 400 Sq. Meters. 4.

He submits that the shifting of the facility would be possible only when following permissions are granted by the concerned authorities: (i) Tree Cutting Permission;

(ii) Building Plan Sanction (NDMC);

(iii) Licensing NOC (LSDA portal);

(iv) Traffic Police NOC;

(v) Law & Order NOC;

(vi) Land owning Agency NOC;

(vii) Fire NOC; and (viii) Final NOC from Jt. CP Licensing.

He submits that if necessary directions are given to the above authorities for expediting the NOCs, the shifting of facility will get expedited accordingly.

He further submits that in case such directions are given he will not press the present suit any further.

In view of the above, the suit is dismissed as withdrawn. 8.

However, regard being had to the urgency articulated by Mr. Mehta, as well as, by Mr. Sanjeev Mahajan, the learned counsel appearing on behalf of the NBCC, all the concerned authorities are directed to expedite the grant of permission as enumerated in para 4 above, preferably within a period of two weeks from the date of application. necessary applications within a period of one week from today. 9.

The liberty is further reserved to the plaintiff to approach the Court in case any fresh cause of action arises.
