O R D E R

The present petition has been filed seeking quashing of FIR No.236/2014 registered under Sections 363/366 IPC at P.S. Jafrabad, Delhi on the ground that the parties have amicably settled their disputes. 2.

As per the allegations levelled in the FIR, the daughter of the complainant went missing.

Learned APP for the State submits that in the present case, the petitioner is the only accused and respondent Nos.2 and 3 are the complainants/victims. He submits that the chargesheet stands filed and the evidence is yet to begin. He further submits that though the petitioner and respondent No.2 got married to each other, they have subsequently obtained divorce vide divorce decree/talaqnam executed on 19.04.2024. Learned counsel for the petitioner submits that the parties have entered into a settlement vide Memorandum of Settlement dated 13.05.2024 and in terms of the settlement, respondent Nos.2 and 3 are now left with no claim or grievance whatsoever against the petitioner. 5.

The petitioner, who is present in the Court, has been identified by his counsel as well as by the concerned Investigating Officer. Respondent Nos.2&3, who are present in the Court, have also been identified by the concerned Investigating Officer.

The petitioner has shown remorse for his conduct and he undertakes not to repeat the same in future. Respondent Nos.2&3 state that they have entered into the aforesaid Memorandum of Settlement out of their own free will, volition and without any coercion. They further state that they have no objection if the present FIR and consequent proceedings are quashed. 7.

Learned counsel for the petitioner submits that no other proceedings are pending between the parties.

The parties shall remain bound by the statements and undertaking made in Court today.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed.

With the above directions, the petition is disposed of alongwith the pending application.
