% 10.02.2026 I.A 3725/2026 (by plaintiff & D-1 & D-3 under Section 151 CPC to place on record MoU/Settlement Agreement dated 03.02.2026 executed between the parties) 1.

The present application is filed under Section 151 CPC but the same is essentially under Order XXIII Rule 3 CPC.

The plaintiff had filed the present suit for partition with regard to the suit property bearing no. E-151, Kalkaji, South Delhi-110019. 3.

During pendency of the present suit, the parties have arrived at a settlement, terms whereof were reduced in writing in the form of Settlement dated 03.02.2026, a copy of which has been placed on record as Annexure A-1 along with the present application.

The plaintiff and defendant no.1 are siblings. Defendant no. 2, who was the mother of the plaintiff and defendant no.1, passed away on 05.02.2026. In so far as defendant no.3 is concerned, he is the brother of the plaintiff and is stated to be having health issues. Accordingly, this Court had appointed defendant no.1 as his guardian vide order dated 28.11.2025. 5.

no.1 on her own behalf, as well as, on behalf of defendant no.3. 6.

The application is also supported by the affidavits. 7.

I have perused the settlement placed on record along with the application, the same is in writing and also signed by the parties. The settlement is lawful.

In that view of the matter, this Court does not find any legal impediment in allowing the present application. 9.

Accordingly, the application is allowed and the suit is decreed in terms of the settlement dated 03.02.2026, which shall form part of the record. The parties shall remain bound by the terms recorded in the said settlement.

The suit and application stand disposed of.
