The arguments in the present petition were heard on the aspect of maintainability of the present petition and the judgment was reserved on 20.02.2025.

The present application has now been filed under Section 528 BNSS seeking withdrawal of the present petition.

The learned counsel for the petitioner submits that he has instructions from the petitioner/applicant to withdraw the present petition with liberty to approach the learned Trial Court.

Mr. Aggarwal, also prays that necessary directions may be given to the learned Trial Court in terms of the following two decisions of the Hon'ble Supreme Court to dispose of the bail application within the stipulated period:
(i) Hussain & Anr. vs. Union of India, (2017) 5 SCC 702 and, (ii) Rajanti Devi @ Rajanti Kumari vs. Union of India, 2023 SCC OnLine SC 1595.

Mr. Aggarwal may bring to the notice of the learned Trial Court the said two decisions of the Hon'ble Supreme Court.
