This hearing has been done through hybrid mode. 2.

The present petition under Section 25B(8) of the Delhi Rent Control, Act, 1958 seeks the following prayers: - "(a) to accept the present RC revision petition and call the records of the Ld. Rent Controller /trial court proceeding for examining legality and regularities of the impugned eviction Order dated 17.05.2025;

(b) allow this RC revision petition and set aside the Impugned Eviction Order Dated 17.05.2025 passed by Ms. ALKA SINGH Ld. ACJ / ARC, West, Tis Hazari Courts Delhi, in eviction suit titled "SMT. SURINDER KAUR VS. RAGHUBIR SINGH" bearing Eviction Petition no. RC ARC 26/2022" (c) Grant unconditional leave to defend to the petitioner herein to contest the eviction petition on its merits;

(d) to grant such other and further relief as may be deemed just and fit in the circumstances of the case."

had passed the following order: - "1. Apropos, the last order dated 28.11.2025, learned counsel for the petitioner/ tenant as also the respondent, who is present in person alongwith his son, submit that the parties have agreed that the tenant shall vacate the subject premises and handover the vacant and peaceful physical possession thereof to the landlord on or before 31.03.2026 as also pay user and occupation charges @ Rs.3,000/- per month on or before the 7th day of each month from December, 2025.

Needless to say, the tenant shall pay/ clear all electricity, water and RWA dues, including all other statutory dues qua the subject premises, and hand over all the requisite documents reflecting the payment(s) of each of the above to the landlords on or before the said date, i.e. 31.03.2026 3.

Learned counsel for the petitioner seeks, and is granted, a period of two weeks, to file an affidavit of undertaking to the aforesaid effect.

None appears on behalf of the parties, despite passover. 5.

On the last date of hearing as well, i.e., 22.01.2026, there was no appearance on behalf of the parties, and the affidavit of undertaking has also not been placed on record.

In view of the above, the present petition is dismissed in default for non-prosecution and disposed of accordingly.
