The present writ petition has been filed seeking directions to take action against the illegal and unauthorized construction raised at the terrace of third floor of property bearing Plot No. 78, Pocket-1, Jasola Vihar, New Delhi.

Responding to the present writ petition, learned counsel appearing for the respondent - Municipal Corporation of Delhi ("MCD"), submits that Show Cause Notice dated 20th November, 2025, has been issued with respect to the whole property, which also includes the property, under the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Accordingly, the MCD is directed to take requisite action against the unauthorized construction existing in the said property, after following the due procedure, in accordance with law.

The concerned parties shall be granted opportunity to file their respective replies and shall also be granted opportunity of personal hearing by the concerned officials of the MCD.

This Court also takes note of the submission made on behalf of the MCD that a letter dated 20th November, 2025, has also been issued to the Station House Officer ("SHO"), Police Station-Sarita Vihar, to ensure that any ongoing unauthorized construction in the property in question is stopped forthwith. Accordingly, the concerned officials of the MCD as well as SHO, Police Station-Sarita Vihar, are directed to ensure that no further unauthorized construction takes place in the property in question. Any construction shall be allowed in the property in question only after requisite permission from the MCD.

In case any party is aggrieved by any action or non-action on the part of the MCD, their right to seek remedies in accordance with law, is reserved. 8.
With the aforesaid directions, the present writ petition is accordingly disposed of.
