The present petition has been filed by the petitioner praying inter alia for issuance of directions to the respondent No.3- The Director General, Sashastra Seema Bal, Ministry of Home Affairs, Centralized Training Centre, SSB, Kangra, Himachal Pradesh, to conduct his review medical board.

Mr. Abhay Prakash Sahay, Advocate, who appears for the respondents on advance notice, raises an objection with regard to the maintainability of the present petition in this Court on the ground that the petitioner is a resident of District Khewra, Sonepat, Haryana and he had W.P.(C) 2463/2016

appeared for the Physical Examination Test (PET) at Himachal Pradesh; his written test was conducted at Chandigarh and he had submitted applications under the Right to Information Act, 2005, to the respondents at Chandigarh and Himachal Pradesh and therefore, no part of the cause of action has arisen in Delhi.

At this stage, learned counsel for the petitioner seeks leave of the Court to withdraw the present petition, while reserving the right of the petitioner to seek his legal remedies against the respondent No.3 before the competent Court vested with the territorial jurisdiction to entertain the same.

Leave as prayed for is granted.

The present petition and the applications are accordingly dismissed as withdrawn.
