This is a petition filed under Section 483 of BNSS seeking regular bail in F.I.R No. 223/2024 filed under Sections 109(1) /221/132/12/1/61 (1) (a)/3(5) of the BNS, 2023 registered at Police Station I.P. Estate. The petitioner is in custody since 15.07.2024.

As per the F.I.R, the petitioner had given lathi blows to a constable who had gone to the site to stop the petitioner and his friends consuming alcohol at a public place.

Mr. Dwivedi, learned counsel for the petitioner states that the injuries suffered by the constable is simple in nature, chargesheet has already been filed and the petitioner is a government employee and hence, there is no likelihood of him absconding.

In the present case, my attention has been drawn to a CCTV footage shown to me in Court today, wherein the petitioner without any provocation has hit the constable in uniform who had gone to the spot where the petitioner was consuming alcohol at a public place. 6.

Even though the nature of injuries suffered by a constable are simple, the way the constable has been attacked with a lathi shows that the petitioner had all intention to cause grievous hurt to the police official performing his duty. The acts of the petitioner are serious in nature and the petitioner was evading arrest and surrendered before the learned MM only after NBWs were issued against him by the learned MM. In case the petitioner is granted bail, there is a possibility that he may jump the bail and be absconding.

For the said reasons, I am not inclined to entertain the present petition at this stage.
