O R D E R

The present writ petition has been filed seeking directions to the respondents no. 1 and 2, to take action against the unauthorized construction being carried out by the respondent no. 3, at property bearing Plot No. 254, T Block, Prem Nagar, Uttam Nagar, New Delhi-110059 (hereinafter the 'subject property').

None appears on behalf of the petitioner.

A status report on behalf of the respondent-MCD has been handed over in the Court.

3.1.

The same is taken on record.

In the status report dated 26th March, 2026, it is stated as under: i.

shape of Ground Floor, First Floor, Second Floor, Third Floor and Fourth Floor with projection on the municipal land has been passed on 9th October, 2025.

ii.

A 'Work Stop' notice has also been issued on 22nd September, 2025 to SHO, P.S. Bindapur.

iii.

A sealing notice has also been issued on 15th December, 2025 and the subject property was sealed on one point at the terrace of the Fourth Floor.

iv.

Since the subject property has been occupied, a vacation notice dated 30th January, 2026 has been issued to the owner/ occupier, calling upon them to vacate the premises.

v.

After the sealing action on 28th January, 2026, a Strict Vigil (Watch and Ward) letter dated 13th February, 2026 has been issued to the concerned SHO.

In view thereof, the present writ petition stands disposed of, with a direction to the respondent-MCD to take steps pursuant to the vacation notice issued on 30th January, 2026.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

7.

All rights, contentions and legal remedies of the owner/occupier shall remain protected.
