The present petition has been filed under Section 528 of BNSS, 2023 seeking quashing of FIR No. 36/2021 under Sections 511/506/451/34 IPC, registered at Police Station Shahdara, Delhi and all proceedings emanating therefrom on the ground that the present FIR is an outcome of a matrimonial dispute and the parties have now arrived at a settlement. 4.
Issue notice. Learned APP for the State accepts notice. He submits that since the present FIR is an outcome of a matrimonial dispute of the petitioner with his wife, the State has no objection in case the FIR in question is quashed.

The petitioner as well as the respondent no.2 are present in the court and they have been identified by the Investigating Officer, SI Naresh Shama, Police Station Shahdara, Delhi.

The brief facts of the case are that petitioner no. 1 got married to respondent no. 2 - Mrs. Nidhi Sharma who is the cousin of respondent no. 2. Due to temperamental differences, matrimonial dispute arose between petitioner no. 1 and his wife which led to registration of another FIR No. 309/2021 under Section under Section 498A/506/34 IPC at Police Station Shahdara, Delhi. The present FIR was also registered by the respondent no. 2 levelling certain allegations against the petitioner. 7.
During pendency of the proceedings, the petitioner no. 1 and the respondent no. 2 have entered into a compromise deed dated 06.12.2024, a copy of which has been annexed as Annexure-P2 to the present petition. It is recorded in the compromise deed that the parties have amicably resolved their disputes. It is also a term of compromise that respondent no. 2 shall cooperate with the petitioner for quashing of the aforesaid FIR. 8.
The respondent no.2, who is present in Court, on a query posed by the Court, affirms the settlement and states that she has no objection in case the FIR in question is quashed.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 11.
In view of the above, the petition is allowed and the FIR No. 36/2021 under Sections 511/506/451/34 IPC, registered at Police Station Shahdara, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Delhi alongwith all other proceedings emanating therefrom, is quashed. 12.
