% 18.03.2016 In view of the judgement passed by this Court in the case of Sh.

Surender Kumar Vs. Sh. Dhani Ram and Others in CS(OS) No.1737/2012 decided on 18.1.2016, and since as per the pleadings in the present suit the only claim to the properties by the plaintiff is on the ground that properties are ancestral properties being HUF properties for the plaintiff to get his share i.e inherited from paternal ancestors, suit is prayed to be withdrawn with liberty to the plaintiff to file a suit on showing a legal cause of action as to how, as per law, plaintiff will have a right to the properties of which partition is claimed.

Suit is accordingly disposed of.
