After the case was argued, counsel for the appellant says that this appeal be disposed of as not pressed, inasmuch as, trial court has also observed, and which is confirmed before this Court today on behalf of the appellant, that appellant has already filed a suit against his brother Sh. Ram Kumar as also tenants, including the present respondent/defendant, and this suit filed against Sh. Ram Kumar and the tenants is pending disposal.

The appeal, along with the pending applications, is accordingly disposed of as not pressed.
