% 19.07.2018 The petitioner was arrested in the context of FIR No. 1558/2015 of Police Station Prashant Vihar involving offence punishable under Section 302/34 IPC on 06.09.2017. Prior to his arrest, five persons were arrested, the case being one of murder of Vipin in a shootout that statedly took place on 08.12.2015, the said Vipin being a witness in another case of murder involving co-accused Hemant and others, the role attributed to the petitioner being that he was the driver of the car in which the assailants had come to the crime scene and in which they had fled away.

The involvement of the petitioner is stated to have come up on the basis of disclosure made by three co-accused persons, namely, Hemant, Rakesh and Ravi. BAIL APPLN. 694/2018

The learned Additional Public Prosecutor pointed out that the petitioner was arrested by Gurgaon police in connection with FIR No. 309/17 under Sections 307/476/34 IPC and 25/54/59 Arms Act and, thereafter, he was sent for trial on the basis of supplementary chargesheet. The investigating agency is probing the case further as the arms recovered by Gurgaon police in the afore-mentioned case are also suspected to have been used in the crime in the present matter, they having been sent to Forensic Science Laboratory (FSL) for examination and opinion.

In these circumstances, this court is not inclined to release the petitioner on bail. The petition is dismissed. R.K.GAUBA, J.
