Writ Petition under Article 226 of Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner with the following prayers: "a. Pass an appropriate writ in the nature of mandamus, directing the 1st Respondent to file a status report of the investigation conducted in case No. PE003205A0005, and to act in accordance with the law on the findings contained therein.

b. Pass an appropriate order or direction against the 1st Respondent to take appropriate actions under law, including but not limited to registering F.I.R., if prima facie evidence of cognizable offences is disclosed from The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the preliminary enquiry report dated 22.09.2025, prepared in case No.PE-003205A0005.

c. Direct Respondent No.2/DDA to immediately halt all construction activities in Plots Nos. 53--64, to remove the illegal construction in the public road and restore the colony entry road to its approved width of24 feet in accordance with the 234th Screening Committee's decision.

d. Pass any other order(s) in favour of Petitioner and against Respondents as this Hon'ble Court may deem fit in the interest of justice."

Learned Counsel on behalf of DDA has pointed out that similar three Writ Petitions have been filed which are either withdrawn or disposed of. 3.

It is submitted that insofar as the prayer for halting ongoing illegal construction is concerned, a similar Petition bearing W.P.(C) No. 4384/2025 was filed.

Considering the totality of circumstances and the nature of relief which has been claimed, the Petition alongwith pending Applications, is disposed of with liberty to the Petitioner to approach the learned Trial Court for the relief sought in the present Petition.
