By way of the instant petition, the learned counsel appearing on behalf of the petitioners prays the following prayers: "a) Issue a writ, order or direction in the nature of Mandamus directing Respondent No. 1, the Central Bureau of Investigation to register a First Information Report forthwith on the basis of the Petitioner's complaint dated 20 September 2024 and subsequent representations; b) Direct the Respondent No 1 to conduct a fair, impartial, and courtThe authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. monitored investigation into the offences disclosed, including the role and conduct of Respondent No. 4 Mr. K.P.S. Malhotra, Deputy Commissioner of Police, Delhi Police;

c) Direct Respondent No. 5, the Commissioner of Police, Delhi to ensure immediate and adequate protection to the Petitioner and her aged mother, Smt. Chandrakanta Randev, during pendency of the investigation and the trial of the accused persons" 2.

As far as the aforesaid prayers are concerned including the prayer for direction to register an FIR is concerned, this Court is of the opinion that the petitioner herein has not yet exhausted all his remedies and he can file an application before the learned Magistrate regarding the same. It is however ordered that in case, such an application is filed seeking registration of the FIR against the respondents herein, the learned Trial Court, considering the urgency in the matter, will decide the application, when it comes up for the first time for hearing before it, within three weeks. 3.

Also, in the meantime, the phone number of the Beat Constable and the SHO be given to the petitioners and in case of need for protection, the SHO concerned will ensure that the petitioners are extended assistance as per law.

In view of the above, the learned counsel appearing on behalf of the petitioners seeks permission to withdraw the present petition with liberty to approach this Court again, in case the need so arises. 5.

Accordingly, the present petition stands dismissed as withdrawn, with liberty as prayed for.
