Writ Petition under Article 226 of Constitution of India has been filed on behalf of the Petitioner with the prayer that Respondents No. 1 to 4 be directed to ensure safety and security of the Petitioner while he has been transported outside Delhi to Lucknow.

It is submitted that the Petitioner is the convict and is facing his sentence in Tihar Jail, Delhi. He has been implicated in criminal offences vide FIR No.

The Petitioner apprehends safety to his life and fears that he may be killed in an encounter while being taken from Delhi to Lucknow. Therefore, necessary directions be made.

It is bounden duty of the State Agency to ensure the safety and security of every individual even if he is a convict, who is undergoing his sentence in the Jail.

It is needless to say that requisite precautions needs to be taken by every Agency involved in transport of the Petitioner as and when, from Delhi to Lucknow. The State Agencies are directed to take the necessary steps.

The Petition alongwith pending Application, is disposed of accordingly.
