This is an application seeking interim bail for a period of 4 weeks in F.I.R No. 549/2017 under Sections 302/34 IPC and chargesheet u/s 302/120-B/34 IPC & 27 Arms Act registered at Police Station New Usman Pur on account of medical exigency.

The medical status report has been perused and the operative portion reads as under:
"It is to be submitted that inmate patient is suffering from multiple stones in Right Kidney with Hydronephrosis and severely impaired Right Kidney Function. The inmate patient gave complaints of Pain Abdomen repeatedly despite providing medications/treatment.
As the symptoms of Epigastric Abdomen Pain with Colic Pain Continues, he was referred to Safdarjung hospital for further management The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The inmate has been advised Right DJ Stent Placement Surgery. The inmate patient has been advised multiple investigations, blood.
Urine test.
Radiological Investigations for further assessment, he is also planned for CT Urogram at Safdarjung Hospital."

No doubt that the petitioner is suffering from kidney issues and requires medical intervention, however, as per the Nominal Roll dated 04.01.2025, the petitioner was granted interim bail on 07.10.2024 till 28.10.2024 wherein he did not surrender on expiry of the term and was re-arrested/re-admitted to jail in the captioned F.I.R No. 549/2019.

The petitioner has two more F.I.Rs pending against him. i.e. F.I.R No. 42/2024 under Sections 25/54/59 Arms Act registered at Police Station Crime Branch and F.I.R No. 302/2016 under Sections 25/54/59 Arms Act, registered at Police Station Seelampur. 5.
Mr. Chadha, learned senior counsel, on instructions, states that he will be satisfied in case direction is issued to the medical jail superintendent to ensure due care and adequate medical facility being made available to the petitioner.

The medical jail superintendent is hereby directed to ensure that the medical condition of the petitioner is looked after and due and appropriate medical treatment be provided to the petitioner. 7.
