The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act'), inter alia, praying that an arbitrator be appointed in connection with the disputes that have arisen out of Memorandum of Understanding (MOU) dated 14.08.2010. The said MOU contains an arbitration clause which reads as under:- "That all disputes or differences arising between the Parties under or in relation to this Memorandum of Understanding, shall be resolved by reference to Arbitration in accordance with the Arbitration and Conciliation Act, 1996. The venue of arbitration shall be New Delhi only."

The learned counsel for the respondent does not dispute the existence of the arbitration clause and states that an arbitrator is required to be appointed. Accordingly, with the consent of the parties, it is directed that an Arbitrator be appointed under the Rules of the Delhi International Arbitration Centre (DIAC). The representatives of the parties shall appear ARB.P. 189/2017

before the Co-ordinator, DIAC on 13.05.2017 at 11:00 AM. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules.

The petition is disposed of.
