% 02.05.2017 After some hearing, the learned counsel for the petitioners, having taken instructions, submitted that he may be allowed to withdraw the writ petition at hand, though with liberty to urge all the contentions raised here before the trial court in the ongoing proceedings arising out of report under Section 173 Cr.P.C. which has since been submitted on conclusion of investigation into FIR No.331/2015, under Section 406/420/498-A/506/120B IPC of Police Station Saket on which cognizance has already been taken and process issued, the petitioners with others having put in appearance in response thereto.

The counsel further submitted that the petitioners may further be given liberty to bring out the necessary facts, if the charge were to be framed, during the course of trial not only by cross-examining the W.P.(CRL) 1152/2014

prosecution witnesses but also by way of evidence to be adduced in evidence.

The learned standing counsel for the respondent/State as also the learned counsel appearing for respondent no.9 (Nidhi Bindal) submit no objection.

The petition along with accompanying applications is dismissed as withdrawn with liberty as prayed being granted. R.K.GAUBA, J.
