Petitioner impugns order dated 03.02.2018 of the Revisional Court, whereby, the Revisional Court dismissed the revision petition, filed by the petitioner, impugning order dated 01.06.2017, passed by the Trial Court summoning the petitioner.

Learned counsel for the petitioner, after some arguments, seeks leave to withdraw the petition. However, he submits that the findings as well as the observations of the Revisional Court are likely to prejudice the petitioner at the time of framing of charge and would CRL.M.C. 1592/2018

preclude the petitioner from making submissions that no case is made out against the petitioner.

Without commenting upon the merits of the case, the petition is dismissed as withdrawn. However, it is clarified that the observations of the Revisional Court, being prima facie in nature, would not come in the way of the petitioner at the time of framing of charge. 4.
