O R D E R

After arguments this appeal is disposed of in terms of the following consent order:- An FDR of the sum of Rs.5,00,000/- has been deposited in this Court by the appellant. The FDR is in the name of the Registrar General of this Court as also the appellant. The Registrar General will encash the FDR and the concerned bank i.e. State Bank of India, Pooth Khurd Branch, Delhi-39, is directed to pay the amount of this FDR in the name of the Registrar General of this Court. On the amount being received by the Registrar General of this Court, the amount will be apportioned to the appellant/defendant and the RFA 328/2017

respondent/plaintiff in the manner that the respondent/plaintiff will receive an amount of Rs.4,50,000/- out of this FDR along with proportionate interest accrued thereon till the date of encashment and the appellant/plaintiff will receive a sum of Rs.50,000/- along with interest accrued there on till the date of encashment.

On receipt of such amounts by the respective parties, all claims of the parties against each other which are subject matter of the present suit will stand settled and satisfied and also that any criminal cases filed under Section 138 of the Negotiable Instruments Act, 1881 will also stand disposed of in terms of the present settlement.

Registrar General will ensure that the FDR is encashed and the amounts are paid by means of banking instruments to the respective parties within a period of six weeks from today.

The appeal is accordingly disposed of in terms of the aforesaid consent order.
