% 29.03.2016 Order dated 05.02.2016 passed by the learned District & Sessions Judge, South has been perused. The suit property does not fall within the territorial jurisdiction of South District; it falls in South East District, Saket. This has been noticed in the said order. Both the parties i.e. the plaintiff as also the defendant were represented before the learned District and Sessions Judge.

In view of the submissions made by the respective parties before the learned Trial Judge, the suit bearing no. CS(OS) No. 1565/2007 titled Sunil Dutt & Anr Vs. Bhag Singh pending before learned District & Sessions Judge, South is directed to be tried by the learned District and Sessions Judge, South East who shall deal with the matter himself or send it to any other Court of competent jurisdiction.

Parties to appear before the learned District & Sessions Judge, South on 08.04.2016 who shall pass appropriate orders of transfer. Petition disposed of.
