TR.P.(C.) 214/2024 By way of the present petition filed under section 24 read with section 151 of the Code of Civil Procedure, the petitioners seek transfer of Test Case No.22 of 2009 pending before this court to the court of the learned Additional District Judge-02, Patiala House Courts, New Delhi for being decided alongwith C.S. No.20/2016 pending before that court.

Mr. Jeevesh Nagrath, learned senior counsel appearing for the petitioner submits, that the probate petition pending before this court as well as the partition suit pending before the learned District Court relate to the estate of late M.S. Sodhi and his wife late Raj Sodhi. 3.

After a brief hearing, learned counsel for the parties agree that the testamentary case as well as the partition suit, which substantially relate to the same estate, are required to be decided together. The court is also informed that evidence in the partition suit before the learned District Judge at Patiala House is now over, and the suit is now at the stage of final hearing.

In the circumstances, the transfer petition is allowed; and it is directed that Test Case No.22/2009 pending before this court be transferred to the file of the learned Additional District Judge-02. Patiala House Courts, New Delhi, to be taken-up alongwith CS No.20/2016. 5.

The Registry is directed to transfer the file of the Test Case No.22 of 2009 to the file of the learned Additional District Judge-02. Patiala House Courts, New Delhi within 01 week.

The petition is accordingly disposed-of.
