% 21.03.2016 Petitioner has prayed in this writ petition that respondent no.2 be directed to stop the unauthorised construction raised by the respondent no.1 in his property. Counsel for the respondent no.2, who has appeared on the advance notice, submits that ongoing construction cannot be termed as unauthorised, per se, since the respondent no.1 has a sanctioned plan in his favour.

Since construction is being raised by the respondent no.1 after getting the plan sanctioned, I am not inclined to entertain present writ petition. Writ petition is dismissed. Miscellaneous application is disposed of as infructuous.
